Seeking Advice, Reporting and Consequences

Retaliation


Seeking advice, raising concerns or reporting misconduct, is always met with support and retaliation will not be tolerated. Anyone engaging in this type of activity will be subject to disciplinary action, up to and including dismissal. If any of our employees suspect they have been retaliated against for raising any legal or business conduct issue, they should immediately contact a manager or other appropriate party.

Investigations


Reported breaches of policy or law breaking will be investigated. All investigations will be conducted by the appropriate personnel within and in accordance with local procedures. For legal reasons, it is vital that the person reporting the violation does not attempt to undertake his or her own investigation. However, all personnel are expected to cooperate fully with any investigation into reported violations.

We will, where practicable and permissible, endeavour to keep the person reporting the issue appraised of the progress and outcome of the investigation.

If action is required to be taken as a result of the investigation, we will determine the appropriate steps to take (including, when appropriate, legal action) to stop the ongoing violation, rectify a problem that already occurred, and reduce the likelihood of its recurrence.

Disciplines for Violations


Disciplinary action, up to and including dismissal, may be taken for authorisation or participation in actions that break applicable laws or policies;

  • Failure to report a violation of such laws or policies;
  • Refusal to cooperate in the investigation of a violation;
  • Failure by an individual’s manager(s) to detect and report a violation; or
  • Retaliation against an individual for reporting a violation.

Everyone at CB Richard Ellis is expected to represent the company with unwavering integrity. This is a personal responsibility and each of our employees is accountable for their own actions. No illegal or unethical act can be justified by claiming it was encouraged or ordered by someone else. Managers have special responsibilities and must set an example and act on any notice they receive.

While the Standards cannot anticipate every situation that might arise in business life at CB Richard Ellis, applying the principles supporting it can help us make the right decisions in most cases.  When an employee needs additional guidance or support, the Standards inform then where they can find help.
